The Noticeboard pages provide specialist legal information, resources, news, and referral options for people who live in residential land lease communities in New South Wales.

Residential land lease communities offer a unique housing situation. Today's land lease communities are varied and interesting places – some are newly developed, others have a long history. At times they have been known as caravan parks, residential parks or lifestyle villages. Whether houses and sites are rented or owned, whether they are called mobile homes or manufactured homes or something else – they are still our homes.

The law applies differently to those who rent a home (tenants) and people who rent only the site (home owners). Please note that some of the information on this site is specific to one group or the other.

The main Act that is relevant is the Residential (Land Lease) Communities Act 2013. However, land lease community law can be complex because other Acts and several sets of Regulations may also come into play in regards to a single issue.

If you are a land lease community resident and need advice on the law, contact your local Tenants' Advice and Advocacy Service (TAAS) for free legal advice. The TAAS Advocates are experts in land lease community laws and residential tenancies laws.

The Tenants’ Union of NSW is a community legal centre specialising in NSW residential tenancies law and accredited by the Community Legal Centres Australia. We are also the main resourcing body for the Tenants' Advice and Advocacy Services (TAASs).

We work with and for residents of land lease communities in the following ways:

  • We undertake policy and law reform activities to protect the rights of residents and improve consumer protection
  • We undertake strategic litigation
  • We provide legal advice, research and training to Advocates
  • We support organised resident groups and associations by providing legal advice, research and resources
  • We publish legal factsheets for tenants and home owners about their rights and obligations under relevant legislation
  • We provide news and information through our publications Outasite and Outasite Lite
  • We provide community education about the law

Residential Land Lease Communities Forum

The Tenants’ Union convenes the Residential Land Lease Communities Forum, which meets quarterly. The purpose of the Forum is to bring together lawyers, advocates and resident representatives from the land lease community field in order to:

  • discuss and share information about what’s happening in land lease communities
  • facilitate knowledge and skill development
  • foster collaboration on policy and law reform activities
  • undertake advocacy with the aim of improving the rights of land lease community residents

Residential Land Lease Communities Working Group

We convene the Residential Land Lease Communities Working Group to inform our policy and law reform work, and collaborate on systemic advocacy. Members include Tenant Advocates and resident representatives with extensive experience and knowledge of land lease communities.
